Expert Witness
Our expert witness work experience is primarily focused on two areas of the law; in nuisance and planning. Dust, smoke and odour nuisance is driven by public nuisance case law in the UK and the Statutory Nuisance provisions of the Environmental Protection Act 1990. For planning, the Town and Country Planning Act 1990 allows for disputed planning applications to be examined by an inspector at a local planning inquiry. Where the positions on individual topics are disputed by the applicant and the local planning authority, experts present evidence on either side to enable the planning inspector to determine the application on behalf of the Secretary of State.
Legal & Planning
DustScanAQ currently provides expert witness services in both legal cases and planning inquiries. Dr Hugh Datson has many years of experience in providing expert evidence in high profile legal action and in planning inquiries. Gordon Allison has given expert evidence to planning inquiries on air quality and climate change in England, Scotland and Ireland, and has been an expert witness to the court in dust nuisance in England. Dr John Bruce has also given expert evidence to planning inquiries on dust and air quality and prepared proof of evidence for inquiries in England. The expert witnesses are supported by the wider DustScanAQ team in preparing and analysing evidence.
