Air Quality Expert Witness
Our expert witness work experience is primarily focused on two areas of the law: nuisance and planning. Air quality, dust, smoke, and odour nuisance cases are driven by public nuisance case law in the UK and the Statutory Nuisance provisions of the Environmental Protection Act 1990. For planning, the Town and Country Planning Act 1990 allows for disputed planning applications to be examined by an inspector at a local planning inquiry. When positions on individual topics are disputed by the applicant and the local planning authority, our air quality expert witness and other specialists present evidence to enable the planning inspector to determine the application on behalf of the Secretary of State.
